Terms of Use

Effective Date: 1 January 2025

  1. Introduction

    1. Ryt Bank Platform. Welcome to our digital banking products, services and platform (together, the “Digital Banking Services”), including our mobile banking application (“App”) and website https://rytbank.my (“Site”) (together, the “Platform”). All references to “we”, “us” or “our”, refers to Ryt Bank or YTL Digital Bank Berhad [formerly known as Sea Capital Services Berhad (Registration No.: 202201037182 (1482879-P))] in these terms and conditions (“Terms of Use”). These Terms of Use set out the terms and conditions that apply when you access and/or use any of our Digital Banking Services or Platform.

    2. For customers in Malaysia only. Our Platform is intended for customers who access it from within Malaysia. Because of this, we cannot guarantee that our Platform or the information thereon complies with the laws or regulations of other countries or is appropriate for use in other jurisdictions. The information provided on our Platform is not intended for use by or distribution to any person outside Malaysia. Information on our Platform should not be taken as communicating any invitation, solicitation or inducement to engage in banking or investment activity outside Malaysia. If you choose to access our Platform from outside Malaysia, you do so on your own risk wherein you are solely responsible for complying with the applicable local laws or regulations.

    3. IMPORTANT: Please read these Terms of Use carefully as they govern your access and use of our Platform. By accessing and/or using the Platform, you accept, understand and agree to be legally bound by these Terms of Use. If you do not agree or cannot comply with these Terms of Use, you should not access, and should immediately discontinue your use of our Digital Banking Services and/or Platform.

  2. Terms of Use

    1. Additional Terms apply. These Terms of Use are to be read together with our Privacy Notice (also known as Notice to Customers in relation to the Personal Data Protection Act 2010) available at https://rytbank.my/privacy-notice (“Privacy Notice”), which is incorporated by reference. Our Privacy Notice governs your use and/or access to our Platform, which explains what data we collect, how we use, who we disclose to, purposes for which we process and your rights under the law. By accessing and/or using our Platform, you consent to and accept the terms of our Privacy Notice. Further and other terms and conditions may apply, if you sign up for our Digital Banking Services.

    2. Your representations. You confirm that you are of a legal age to contract with us (i.e. at least 18 years old). You are wholly responsible for your use of and/or access to our Platform, including possession and control of your electronic device or equipment used to access our Platform from time to time. Any use of our Platform by minors under the age of 18 is at all times subject to the consent and supervision of such minors’ parents or guardians.

    3. Changes to Terms of Use and/or Platform. We may update, amend and/or supplement our Terms of Use and/or Platform from time to time. You are advised to visit our Platform regularly to ensure you are kept up to date. We reserve the right to make changes to our Terms of Use and/or Platform at any time with or without notice. You will be notified of material changes via appropriate means as we may determine. Your continued use of our Platform after our amendment to these Terms of Use means you have agreed to be bound by these updated Terms of Use.

  3. Disclaimers

    1. Our Content. The information and content contained in and/or accessed through the Platform are for general information only. They are provided on an “as is” and “as available” basis. These include all text, images, photographs, trademarks, logos, user interfaces, graphics, music, sounds, videos, artwork, messages, tags, software, and files (collectively, “Content”). We do not represent or warrant that such Content is and will remain accurate, adequate, up-to-date or appropriate for use in other locations. You should not rely on such Content as advice (be it financial, legal or any other type of advice). Please seek independent professional advice before you make any decision. 

    2. Our Digital Banking Services / Platform and Right of Access. Whilst all reasonable care has been taken to prepare the Content on our Platform, we do not provide any warranty (whether express, implied or statutory) in respect of security, quality, fitness for a particular purpose, accuracy, quiet enjoyment, availability, freedom from malware (such as viruses, spyware, adware, worms, trojans, ransomware or other malicious software), or non-infringement of third party rights. We also reserve the right to impose limits on certain features or restrict your access to the whole or part(s) of our Platform with or without notice.

    3. Our Platform. We do not represent or warrant that use and/or access to our Platform (in whole or in part) will be uninterrupted and free from errors or that there will be no delays, failures, errors or loss of transmitted information, that no malware or other destructive content will be transmitted or that no damage will occur to your electronic device or equipment. You are responsible for installing and maintaining the appropriate anti-virus, anti-malware and security measures on any devices you use to access our Platform. You are responsible for configuring your information technology/mobile devices, computer programmes and platforms in the appropriate manner to access our Platform. We reserve the right to change, modify, suspend, discontinue or upgrade the whole or any part(s) of our Platform from time to time and may require your prompt cooperation to implement any software or hardware upgrades to remove and/or prevent any virus or other malware attacks. You acknowledge that our Platform and our operations may be subject to technical or other problems that are beyond our control, including without limitation problems concerning the operations of a third-party service provider.

    4. Authentication. You acknowledge and agree that, for security purposes, we require you to authenticate yourself with passcode, fingerprint and/or facial recognition functions on your mobile device before you are able to access our App. We may require you to also perform additional passcode, fingerprint and/or facial recognition authentication to update your settings, preferences, limits and/or perform transaction(s) within the App. While we may utilise the passcode and/or biometric authentication capabilities provided by your mobile device manufacturer (such as touch ID and/or face ID) for all such said purposes, we make no representation or warranty as to the security of the biometric or passcode features provided by your mobile device manufacturer.

    5. Your Own Risk and Discretion if You Decide to Use AI Tools. We may utilise artificial intelligence (AI) powered systems, products and tools (the “AI tools”) in various touch points or tools including but not limited to making available an interactive AI-powered Help & Support Centre chatbot to provide responses to your queries. Should you decide to use such AI tools, you should understand and accept the risks that such AI tools may inherit and be subject to the limitations of its underlying technology, such as:

      1. Possible Hallucinations: The AI tools may produce plausible-sounding but incorrect or nonsensical answers.

      2. Bias and Ethical Concerns: The AI tools may exhibit biased behaviour or produce responses that may be unethical or immoral.

      3. Contextual Understanding: While proficient at text processing, the AI tools may lack human-like understanding of context, which could result in inappropriate or nonsensical responses.

      Subject to any applicable guidelines or policy documents issued by Bank Negara Malaysia (“BNM”), we disclaim all warranties and representations regarding the AI tools, including their features, functionalities, outputs and/or the results that may be obtained from the use of the AI tools. Use of the AI tools is provided “as is”, “with all faults” and “as available”, without any warranties, express or implied and we expressly disclaim all such warranties or representations, including but not limited to any implied v. September 2024 3 warranties or representations of merchantability, fitness for a particular purpose, accuracy, quality, completeness, non-infringement, reliability, availability and performance. We do not warrant or represent that the AI tools and/or their output will be uninterrupted, error or bug free, non-offensive, non-infringing, non-harmful, accurate, lawful or appropriate.

      You acknowledge and agree to use the AI tools at your own risk and discretion, only for lawful purposes. The decision to use or rely on these AI tools rests solely with you. Subject to any applicable guidelines or policy documents issued by BNM, should you decide to make use of any AI tools, you accept full responsibility for any consequences, damages, or losses that may arise from your use of the AI tools. It is your responsibility to assess and critically evaluate the responses provided by the AI tools and for verifying all such information when necessary. In the event of any inconsistency between the responses provided by the AI tools and the relevant terms and conditions to which your queries relate, you agree that the relevant terms and conditions shall prevail to the extent of such inconsistency.

  4. Use of Our Platform

    1. Your Responsibility. You must use our Platform for lawful purposes only. You must not use our Platform in a manner for any purpose that is unlawful or prohibited by these Terms of Use or such other guidelines or requirements as we may specify. You must not download, install and/or use the App: (a) on a mobile device which you do not own, do not have exclusive control of or possession over; or (b) on a rooted or jail-broken mobile device. Modifications to any mobile device operating systems (i.e. “jailbreaking or rooting”) bypasses security features and can cause numerous security and operational issues with the hacked devices. FAILURE TO PROTECT YOUR DEVICE, ACCOUNT INFORMATION, USER ID, PASSWORD, PASSCODE OR OTHER LOGIN CREDENTIALS OR FAILURE TO COMPLY WITH THESE TERMS MAY RESULT IN SOMEONE ELSE BEING ABLE TO ACCESS THE APP AND/OR YOUR ACCOUNTS IN YOUR NAME. WE WILL CONSIDER ANY ACCESS AND ANY TRANSACTION USING YOUR USER ID AND PASSWORD, PASSCODE OR OTHER LOGIN CREDENTIALS AS BEING AUTHORISED SOLELY BY YOU. TO THE FULLEST EXTENT ALLOWED BY LAW, YOU ASSUME ALL RISKS OF FRAUDULENT OR UNAUTHORISED ACCESS OR TRANSACTIONS MADE WITH YOUR USER ID AND PASSWORD, PASSCODE OR OTHER LOGIN CREDENTIALS. You must immediately report any fraudulent and/or suspected fraudulent and/or unauthorised activities and/or transaction(s) on our App or our Site by contacting our Support Agent at the following contact details:

    2. Downloading the App. To access and use the Digital Banking Services through our App, please download and install the App from the official Apple App Store in Malaysia or official Google Play Store in Malaysia (collectively, the “Malaysian App Store”). Your download, installation and use of our App from the Malaysian App Store is subject to further terms of services which the respective Malaysian App Store may impose. We are not a party to those terms of services.

    3. App Software Update. App software updates may be automatically downloaded for some mobile devices. If this does not happen automatically for your device, you agree to log on to the App regularly and manually download and install such updates. You may be restricted from accessing or using the App unless the latest software updates have been installed.

    4. Mobile Devices. Our App can only be installed on mobile devices that meet the required specifications and configurations as we may specify from time to time. We do not guarantee that the App will be compatible with your mobile device. You are responsible for obtaining and maintaining all mobile devices or equipment needed (including all related charges) for access to and use of the Platform. Your mobile devices or equipment must meet such specifications and configurations. Therefore, save and except for gross negligence, wilful default or fraud on our part, we shall not be liable for any loss or damage (whether direct, indirect, or consequential) in respect of any matter of whatever nature and howsoever v. September 2024 4 arising (whether in contract, tort, negligence or otherwise) in connection with any delay, failure, disruption, malfunction or security breach arising from or in connection with your access or use of our App or Platform, reliance on the information contained on our App or Platform, technical, hardware or software (including internet browser) or network connection or your failure to adhere to any specification and/or configuration as may be specified by us or the respective Malaysian App Store. This exclusion clause will take effect to the fullest extent permitted by law.

  5. Third Party Links

    1. For your convenience, we may include in our Platform hyperlinks to websites, mobile applications, software and platforms that are owned, offered or operated by our affiliates and/or other third parties such as DuitNow (“Third Party Links”). We do not have control over the contents of any third-party websites and we do not accept responsibility for the contents, quality, nature or reliability of or the consequences of accessing any of the Third Party Links or the contents therein. The inclusion of Third Party Links in our Platform is for your information and intended to enhance your user experience only, and must not in any way be taken or construed as any endorsement, guarantee, verification, approval, warranty or recommendation of the Third Party Links or the contents therein by us. You agree that your use of and/or access to such Third Party Links is entirely at your own risk and subject to the terms of access and/or use contained in such Third Party Links. 

  6. Intellectual Property Rights

    1. Unless stated otherwise, you acknowledge that all Content available on our Platform, is at all times protected by copyright, trademarks, service marks, brand names, logos and other intellectual property and owned exclusively by us or where applicable, the relevant third party owners or licensors (which we may identify on our Platform).

    2. Other than the right to use the Platform for the Digital Banking Services, you have no intellectual property rights in or to our Platform. Should you breach any of these Terms of Use, we may terminate your right to use and/or to access our Platform immediately.

    3. Unless you have our prior written consent:

      1. no part of the Platform or the Digital Banking Services or any Content may be copied, reproduced, distributed, displayed, hyperlinked, transmitted (in any form or by any means), adapted, modified, or sold to create derivative works or otherwise commercially exploited in any manner or by any means. By using and/or accessing our Platform, you agree to comply with all applicable laws including copyright, trademark, service mark laws that protect our Platform and its Content.

      2. you may not, and may not attempt to, directly or indirectly:

        1. use any part of the Platform for any commercial purpose or otherwise infringe our intellectual property rights;

        2. “mirror” or frame any of the Content on any other server or as part of any other website; or

        3. use any robot, or any other automatic device or manual process to monitor, scrape or copy the Content on our Platform. Notwithstanding this, consent is deemed given for standard search engine technology employed by internet search websites to direct internet users to our Website.

  7. No Unlawful or Prohibited Use and/or Access

    1. As a condition of your use of our Platform, you undertake at all times that:

      1. you shall not access and/or use our Platform in a manner that has or could have the effect of damaging, disabling, overburdening, impairing or compromising our systems or security or interfere with other users of our Platform; 

      2. you shall not introduce any Malicious Code which may or will impact, damage, or interfere with our Platform. “Malicious Code” refers to any code, files, scripts, agents or programs designed or intended to harm, breach the security, and/or gain unauthorised access, including, for example, viruses, worms, time bombs, automated rootkits, spyware, trojan horses and other malware;

      3. you shall not decompile or disassemble the Platform or reverse compile, reverse assemble or reverse engineer the Platform or any part thereof from object code into source code or attempt, authorise or permit the same in any manner or for any purpose whatsoever;

      4. you shall not translate, merge, adapt, vary, alter or modify any part of the Platform nor permit the Platform to be combined with, or become incorporated into, any other programs or applications, except as may be necessary to use the Platform on equipment as permitted under these Terms of Use;

      5. you shall not collect, scrape nor harvest any information or data from or through the Platform or attempt to decipher any transmissions to or from the servers running the Platform; and

      6. you shall comply with all applicable technology control laws and regulations that apply to the technology used or supported by the Platform.

  8. Termination of Access and Use

    1. Without prejudice to other rights we may have by contract or at law, we reserve the right to terminate your rights to use or restrict your access to the Platform at any time if you are in breach of these Terms of Use, in which case:

      1. you must stop all activities authorised by these Terms of Use, including your access and/or use of the Platform;

      2. we will suspend or terminate your use and access of the Platform, including the Digital Banking Services offered to you;

      3. we will be entitled to remove any information submitted, uploaded or shared by you through the Platform; and

      4. you must delete or remove the Platform from all devices in your possession and immediately destroy all copies of the Platform.

  9. Indemnity

    1. You agree to fully indemnify and keep us indemnified from and against all claims, liabilities, losses or other expenses (legal or otherwise including costs on a solicitors and client and party to party costs basis) which we may suffer or incur in connection with or arising from:

      1. your breach of any of these Terms of Use; or

      2. your access to and/or use of our Platform and/or use of the Digital Banking Services,

      including any violation or misuse on the part of your authorised representative or agent, if applicable.

  10. Exclusion and Limitation of Liability

    1. We will take reasonable steps to ensure that our operating systems have adequate security protection, taking into account applicable regulations and prevailing market practices. In addition to (and not in derogation of) the express provisions in these Terms of Use, we shall not be responsible or liable for any loss or damage howsoever arising (whether direct, indirect or consequential), whether foreseeable or not, that you or any other person may incur or suffer arising from and/or in connection with your access, use and/or inability to access and/or use our Platform, to the fullest extent permitted by law.

    2. We will not be liable for the following losses that you may incur or suffer arising from or in connection with:

      1. your use and/or reliance on the Content;

      2. us acting on any instructions that we reasonably believe to have originated from, authorised by or to have come from you;

      3. any failure or delay in our or our agents’ performance, response or execution of any transactions based on information, data or instructions given by you or your authorised representatives or agents, except to the extent caused by our own fraud, wilful default or gross negligence;

      4. any failure or delay in the execution of any of our obligations due to any causes beyond our control including strikes, industrial action, civil disturbances, war, invasion, flood, earthquake, landslides, acts of God, computer, electronic, communications or electrical system failures of any nature whatsoever, malfunction or breakdown, or the interruption, non-supply, breakdown or failure in supply of electricity or power for any length of time, change of laws or regulations, pandemic, epidemic, or other outbreak of communicable diseases, etc.;

      5. any delay in transmission, interruption, errors or omissions contributed or caused by your mobile device, equipment or systems, or other software, malware, or related problems;

      6. breakdown of any equipment, system, network services, server software or terminal except to the extent caused by our own fraud, wilful default or gross negligence;

      7. any attack or interference by any computer virus, other malware or Malicious Code, corruption, or by any person except to the extent caused by our own fraud, wilful default or gross negligence; or

      8. any damage arising from the installation or use of our Platform or any component of our Platform.

  11. General

    1. Waiver. Failure or delay in exercising or enforcing our rights and remedies under these Terms of Use shall not constitute a waiver. We reserve all rights to enforce such rights and remedies under these Terms of Use.

    2. Severability. If any of these Terms of Use is or becomes invalid, illegal or unenforceable in any respect, the validity, legality or enforceability of the remaining Terms of Use shall not be affected or impaired.

    3. Governing Law and Jurisdiction. Notwithstanding the place or places from which you obtain or attempt to gain access to the Platform and/or the Digital Banking Services, you agree that these Terms of Use shall be governed by and construed in accordance with the laws of Malaysia. By accessing our Platform, you consent and submit to the exclusive jurisdiction of the courts of Malaysia to resolve all disputes arising from or in connection with the use of our Platform. We may take enforcement action and initiate proceedings against you in the courts of any other jurisdiction, including jurisdictions you may reside in or where your assets may be located.

    4. Feedback and Complaints. If you want to learn more about the Platform or experience any issues with using them or if you have feedback or complaints regarding our Platform, you may contact us at support@rytbank.my.

      Please note that we shall have full liberty to use and act on all such information, feedback or complaints.
